What is a whiplash injury?
A whiplash injury is an injury to the neck caused by forceful, rapid back and forth movements of the neck, like the cracking of a whip. Most whiplash injuries are caused in road traffic collisions when a vehicle is hit from behind, but it can be caused other things too (assault, falls, blow to the head).
From 31st May 2021, the personal injury claims process has changed for people who suffered from whiplash in road traffic collision claims. This affects how much compensation you can receive, the amount of legal costs you can recover from the insurer of the driver responsible for your injuries, as well as how the claim is processed. What are the symptoms of whiplash?
Symptoms of whiplash can be wide ranging and may include neck, shoulder and back pain, stiffness, reduced range of movement, instability and weakness. It can also include headache, tingling and numbness.

What is my whiplash injury compensation claim worth?
The new whiplash injury claim process has changed how much compensation you may receive for the pain and suffering you have experienced as a result of your injuries, as well as how your injuries have affected your way of life. Awards now range from £240 to £4,345 depending on how long your injury and symptoms last and whether you have also suffered minor psychological injuries.
You can also claim for the expenses you have incurred as a result of your injuries including, for example, travel expenses for medical treatment, physiotherapy charges or loss of earnings if you had to take time off work because of your injuries and you lost pay as a result.
How long do I have to make a whiplash injury compensation claim?
Normally, you have three years from the date of your injury. However, certain types of claims (like if you were in a road traffic collision abroad) may have different time limits. So, if you think you may have a whiplash injury compensation claim, it is vital you seek legal advice as soon as possible.
How long will my whiplash injury compensation claim take?
This depends on a number of factors including the severity of the injuries sustained, whether you require any medical treatment and rehabilitation, and whether the insurer of the driver responsible for your injuries has admitted fault (‘liability’). A straightforward road traffic collision compensation claim may take 6 to 12 months to complete. If liability is disputed, or you need rehabilitation and medical treatment, it could take 12 to 18 months. Complex cases can take significantly longer.
